Montana Supreme Court Upholds Lower Court Injunction on Restrictive Abortion Laws

October 15, 2024

The Montana Supreme Court has affirmed a previous judgment released by a lower court, granting a preliminary injunction to prevent enforcement of laws that would have prohibited Medicaid reimbursement for abortions performed by anyone other than a physician. The laws would have also required an unnecessary physical examination as well as additional documentation and patient information to be sent to the state for prior authorization.

In April, AAPA joined the Association of Physician Associates in Obstetrics and Gynecology (APAOG), the Association of Nurse Practitioners in Women’s Health (NPWH), and the American College of Nurse-Midwives (ACNM) in an amicus brief to the Montana Supreme Court in support of the injunction, stating that the laws would “deprive Montanans of their fundamental right to seek abortion services from a qualified healthcare provider of their choice.”
